Guard Conduct Manual, part 6

9) Guard Misconduct & Punishment

Guards, like all officials, must be model citizens.

There are two forms of misconduct for guards, criminal acts and procedural misdeeds.

Any guard convicted of a crime will be removed and punished as appropriate to the crime.    Warnings are not mandatory to guards (though for lesser crimes they are allowed) because it is a duty of guards to know the law.

Abuse of power is a serious crime.

Procedural errors are misdeeds that violate only the guard code of conduct but do not violate Mileth Law.    These include (but are not limited to):

-failing to meet the commitment of 40 hours of service per double-moon
-failing to attend guard meetings
-failing to make timely reports
-failing to respond to citizens' requests for aid
-failing to warn a criminal before banning when the law requires such (if there is proof of crime)
-banning improperly where there was no apparent will to abuse power, but only a misunderstanding of law.

In these cases or procedural error, the Guard Captain(s) will judge, with consultation from higher officials where appropriate.

A first offense might result in probation for the guard, or in further education of the guard.

A second offense of the same nature in the same term should require removal of the guard; no further action is mandated.

Additional infractions of the same sort after the second should be dealt with as second infractions, should the guard be returned to office.

If a guard is accused of either breaking the law or of procedural error, that guard should cooperate with the inquiry.    They may also request a hearing by the Captains in term, who will decide the case.
