III. Exam Investigations
Proof of valid testing for the office of Guard may only be requested by a Guard Captain or a Judge.
Proof of valid testing for the office of Guard Captain (or Judge, in the case that the Judge was required to take an entry exam prior to taking office) may only be requested by a Judge.
Proof of valid testing for the office of Demagogue (or Burgess, in the case that the Burgess was required to take an entry exam prior to taking office) may only be requested by a Burgess.
This proof is requested from the testee and tester, as outlined in section II of this mandate.
In the event that the senior Guard Captain or Demagogue is the one that required an entry exam before entering office (and no Judge or Burgess is able or available to), then the junior Guard Captain or Demagogue may request proof of valid testing as outlined above.
Additionally, any officials who lack a valid exam, are conditionally ignored for superiority/substitution for investigations/etc defined in the law. Only Guard Captains or Demagogues and above in either branch may ignore requirements for investigation.
Note: The investigating official cannot be a guild member or a family member of the aisling who is being requested to show proof of valid testing, nor can they have been either within the previous double-moon.
IV. Malpractice
All exams should contain content which is relevant to the office being sought. Testers have the freedom to create different types of tests or testing methods. Should any exam thought to be unfair or contain content which is irrelevant, an investigation may be opened and determine validity. If an exam is found to have invalid content for such an exam being given, the official responsible may be given a Demerit or Probation depending on the severity.
V. Punitive Action
If an official is ordered for removal as a result of this mandate, invalid test, a barment may ordered if:
A. They perform non-malicious action(s) before a valid removal order is created (1 Deoch)
B. They perform non-malicious action(s) after a valid removal order is created (1 Deoch/action)
C. They successfully complete their term without removal (1 Deoch)
Action in this case is defined as use of powers or behavior possible only by office. These barment lengths are additional if other laws are broken.
Note: If an individual wishes to take an office entry exam but all officials that are permitted to test this individual are in the same guild as this individual then, and only then, may a guild member test the individual. Family members may never administer a test to another family member.
